Whelan Digital Pte. Ltd. provides marketing services including local postcard marketing, direct mail advertising, local advertising placements, email marketing, newsletter support, copywriting, campaign planning, and related marketing services.

The specific scope of services, deliverables, timelines, fees, and any relevant deadlines will be confirmed in writing before payment is requested. This may be done by email, invoice, payment request, proposal, statement of work, or other written confirmation.

3. Pricing and payment

Pricing varies depending on the service, scope, campaign format, amount of work required, deadlines, print requirements, distribution area, and other project details.

Typical pricing ranges are displayed on our website. Final pricing is confirmed with each customer before payment is requested.

Payments may be processed by third-party payment providers, including Wise, Stripe, bank transfer providers, or other payment processors. We do not store full payment card details on our website.

Invoices and payment requests are due according to the payment terms stated at the time of purchase or on the invoice. Late payment may result in paused or cancelled services.

4. Customer responsibilities

Customers agree to provide accurate and complete information needed for us to perform the services. This may include business information, contact details, logos, images, offer details, target locations, deadlines, and approval of drafts or campaign details.

Customers are responsible for ensuring they have the right to use any materials, logos, images, testimonials, claims, or other content provided to us.

5. Approvals and deadlines

Some services require customer feedback, approval, or confirmation before work can continue. Delays in providing feedback, approvals, assets, or information may affect timelines and delivery dates.

For postcard marketing and direct mail campaigns, print and distribution timelines may depend on third-party suppliers, delivery companies, printers, distribution partners, and local campaign schedules.

6. Refunds and cancellations

Refunds and cancellations are handled according to our Refund and Cancellation Policy, which forms part of these Terms.

In general, customers can cancel before work starts for a full refund. Once work has started, partial refunds may be offered depending on work completed and costs incurred. Once print production, advertising placement, or distribution has begun, postcard marketing payments are generally non-refundable unless we are unable to provide the agreed service.

7. Service delivery

Marketing services are provided remotely unless otherwise agreed. Deliverables may be provided by email, shared documents, design files, online links, payment platform messages, or other agreed methods.

For direct mail and postcard campaigns, delivery may include coordination of print, placement, distribution, or campaign execution. Exact deliverables are confirmed before payment.

8. No guaranteed results

We aim to provide professional marketing services and practical campaign support. However, marketing results can vary based on many factors outside our control, including market conditions, offer strength, local demand, audience response, competition, seasonality, pricing, and customer follow-up.

Unless explicitly agreed in writing, we do not guarantee specific sales, leads, revenue, rankings, response rates, or other commercial outcomes.

9. Intellectual property

After full payment, customers own final deliverables created specifically for them, unless otherwise agreed in writing.

Whelan Digital Pte. Ltd. retains ownership of its pre-existing materials, methodologies, templates, processes, know-how, frameworks, and internal systems.

10. Third-party services

Some projects may involve third-party platforms, printers, designers, distribution companies, email service providers, payment processors, hosting providers, analytics tools, or other suppliers. We are not responsible for outages, delays, errors, changes, or decisions made by third-party providers.

11. Confidentiality

Both parties agree to keep confidential information private and to use it only for the purpose of providing or receiving the services. Confidential information may include business plans, customer lists, financial information, campaign data, private documents, and other non-public information.

12. Limitation of liability

To the maximum extent permitted by law, Whelan Digital Pte. Ltd. shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, goodwill, or anticipated savings.

Our total liability for any claim relating to a service shall not exceed the amount paid by the customer for the specific service giving rise to the claim, unless applicable law requires otherwise.

13. Website use

You agree not to misuse this website, attempt to gain unauthorised access to it, interfere with its operation, or use it for unlawful purposes.

14. Governing law

These Terms are governed by the laws of Singapore. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore, unless applicable law requires otherwise.
